Joshua N. Garick obtained a $67,339.83 Judgment in the Norfolk County Superior Court in a case brought pursuant to the Massachusetts Wage Act for unpaid wages and unpaid overtime wages. The plaintiff, a cashier at a convenience store in Canton, Massachusetts, was required to work extensive hours. On average, the employee worked over 85 hours each week. For a period of time exceeding a month, the plaintiff was required to work 140 hour work weeks (i.e., 20 hours a day, 7 days per week). Despite these astonishing hours, the defendant never once paid overtime wages.

The Massachusetts Wage Act, with limited exceptions, requires payment of “time and a half” for each hour worked over 40 hours. If an employer fails to pay proper overtime wages, the employee is automatically entitled to triple damages, attorneys’ fees and costs to file the lawsuit. Here, there was more than $14,000.00 in unpaid overtime wages. As a result, the Court awarded the following damages:

$43,920.00  (Treble Damages)
$17,779.00 (Attorneys’ Fees)
$1,345.63  (Costs)
$4,295.20 (Prejudgment Interest)

$67,339.83  (Total Judgment)
