September 4, 2013:

The Law Offices of Joshua N. Garick, P.C. successfully represented a client whose application to become a licensed building inspector was denied by the Board of Building Regulations and Standards, a division of the Executive Office of Public Safety and Security. The Board’s decision, like all decisions made by an administrative agency, was reviewable at a hearing held pursuant to G. L. c. 30A – the Massachusetts Administrative Procedures Act. At a hearing before the nine member board, Attorney Garick made a presentation showing that his client was qualified to become an inspector and that the application was denied in error. The decision was overturned, and the client’s application to become a licensed building inspector was immediately approved.

Importance of Administrative Hearings: If you have received an unfavorable decision from an administrative agency, the Law Offices of Joshua N. Garick, P.C. highly recommends hiring an attorney to represent you at the administrative hearing. The results of these hearings may be final, so it is important to have an attorney present at the hearing to ensure hearing procedures are properly followed, and that a decision is legally sound. Courts have limited powers to review a decision made by an administrative agency, and you will be unable to have another full hearing before a court if you disagree with the board’s findings. Thus, your best opportunity to contest a decision is at that agency’s hearing. If you have an upcoming hearing, please contact us to see if the Law Offices of Joshua N. Garick, P.C. can help you.
